October 26, 2011 – Day 86 of Morgan’s Stalking

In case the good news slipped under the radar, on the 56th day of the stalking, Morgan’s case was confirmed to be a felony stalking case.  It was 56 days, and it was finally a felony stalking case.  Fifty-six days!  I have read the Colorado Revised Statutes twice, and I don’t see any time restriction, law enforcement does not even have to wait one day.  The US Department of Justice says, “Stalking is a pattern of repeated and unwanted attention, harassment, contact, or any other course of conduct directed at a specific person that would cause a reasonable person to feel fear.

Morgan felt fear from day two.  Steve and I felt fear as well – fear for our daughter’s safety, fear of the unknown.  All of our lives were turned upside down…this had been 56 days of REPEATED harassment, unwanted surveillance, tresspass, and attacks.  The stress we were all under was unbelievable.  I have posted – just when does stalking become stalking?  Today to answer this question, again, it is a pattern of repeated and unwanted attention, harassment, contact, or any other course of conduct directed at a specific person that would cause a reasonable person to feel fear.  I would also further like to point out – this is why I believe anti-stalking laws have to become stricter.  It’s one thing to have anti-stalking laws on the books, but it’s another to have those laws enforced, because if locally they are not taken seriously, stalking can become lethal.

At 11:59 pm a rock hit Morgan’s window, and startled her from bed.  Earlier today Steve went outside with a new BB gun, and using plastic bullets to try to approximate the noise Morgan had been hearing on her windows up till tonight.  This was much louder and more upsetting for Morgan.

I sent the detective an email about the incident, which had been caught on the video cameras in the driveway.  He said he is interested to see it next time he is at our house.  I didn’t tell him about the rock incident, as it had to wait until he got back anyway.

Today is October 15, 2012 – And yesterday’s blog was such a perfect example of what I mean about protocol, and laws changing in stalking that I could not pass it up.  Yesterday on the blog, I posted a film clip of a stalker in the driveway.  A strange man doing something nefarious, and I say this because who else would be out in our driveway at 11:30 pm at night crouched behind my car in the driving rain?  And how often would evidence like this be available in a stalking case?

Our sheriff, Lou Vallario has gone on TV and said they were out at our house over 50 times and never saw any sign of a stalker.  His detectives saw this video clip on my computer (and it was very clearly a picture of a male popping up from behind the LR3 into a standing position and running across the driveway to the bushes for cover as our new neighbor Matt drives up the street), and if that is not a sign of a stalker then just what is?  The stalkers don’t come to the front door, and politely request a sign in sheet saying they were there, not our stalker anyway.  Our stalker actually did whatever it took to not be caught in the act – is this a shock to anyone?  In this particular clip we caught him because a neighbor happened to drive up the street while he was hiding behind my car.  If he comes toward the house between the truck and the car then the alarm goes off, the stalker knows this.  He had one way to go – no other way, and he took it.

Lucky for the stalker, Matt did not see him.  Or would that have mattered?  Say Matt saw him and told the detectives he had seen a man leaving our driveway, and hiding in our bushes, would they have arrested someone?  NO!  Would they have gone and questioned someone?  NO!  Based on past reactions to far greater evidence, there would have been no response at all.  Just like there was on October 19th when Morgan was followed home in her car.  Morgan was frightened and frustrated.  She was beginning to lose all faith in the sheriff department’s ability to protect her, or catch her stalker at this time.  And looking back wasn’t she 100% right?  They never caught her stalker, and they were not able to protect her.  They managed a very pathetic murder scene investigation, which they instantly saw as absolutely unrelated to her ongoing stalking.  100 pages of gross incompetence reports later and what crime, there was no crime here, no stalking, no murder…who really believes that?

Interestingly enough the volunteered votes to convict so far on the blog, if those chiming in were on a jury, and had to find guilt beyond a reasonable doubt, the prime suspect Keenan, is, so far, 100% guilty – based only on the blog to date.  And trust me you have not seen the really damning stuff yet.  100% guilt and the sheriffs department has closed the stalking investigation, and the pathologist carried through on his threat, and changed Morgan’s death from natural causes to a suicide, after nine months with no new evidence.  Steve and I were dismayed when the sheriffs indicated that they were 100% certain Keenan was the stalker, because we were far more convinced that Keenan was acting as part of a gang and there were others involved.  We believed there were at least one other, and maybe two other participants at the time.  Now we believe there were at least four participants in total and perhaps as many as five.  And the sheriffs department has dropped the case, felony stalking one day – next day, no stalking, and what changed?  NOTHING!  We believed in the system and what happened – so far there has been no justice for Morgan – people responsible are still out on the streets to go do this again to someone else’s daughter and until changes are made this will just repeat itself over and over again.

Oh, Morgan died, was killed, or committed suicide, that has changed.  But does any of that mean she was not stalked? I think not, not at all.  Steve and I spent over four hours this weekend listening to interpretations of the crime that could lead to a correct manner of death as suicide.  Steve and I said nothing, just listened, and not one person thought this was even a POTENTIAL suicide.  Not one.  And what if it were a suicide?  What if the fear of her stalker drove her to that, how come nobody even wants to mention that as a possibility.  Steve and I are 100% certain it was not a suicide for many reasons that will be shared with you over the next few weeks.  Then you too can decide for yourself.  Just remember, anyone who still votes for suicide will have to answer the question if it could have been caused by her stalker.  And we have not even raised the reason for her death that medical minds thought was most likely, before we found the massive dose of amitriptyline, and before we later found the components of a date rape cocktail.  So answer me this, because I’m her mom, and I don’t get a vote:

  • 100% felony stalking case (plus)
  • Substantial reality of fright from her stalking being a small component in her untimely death (plus)
  • 100% massive dose of Amitriptyline listed as insignificant (plus)
  • 100% evidence of a date rape cocktail of 6 drugs in her system (plus)
  • Ample evidence of a struggle in her room (plus)
  • The PJ’s she wore to bed completely gone from her room (plus)
  • All of her valuable jewelry missing from her room (plus)
  • A suspicious substance (bodily fluids), in minute spots on her chest & neck under black light (plus)
    • Shown in pictures the sheriffs took under the UV light at the crime scene
  • A suspicious substance (bodily fluids), in minute spots over what looks like an injection mark with a human BITE mark over it on the inside of her arm
    • Shown in pictures the sheriffs took under the UV light at the crime scene
  • Wounds on the top and bottom of her right hand (plus)
  • Three nails torn off her right hand (equals)
  • Body found in a completely different position then the position determined that she died in – body moved postmortem!
  • ZERO INVESTIGATION, NONE, NADA.

What if your daughter was murdered and no one cared? What would you do?  Could this possibly get any more pathetic? Of course it can, it is Garfield County isn’t it?

  1. Not sure if you saw on your fb page but today I was followed from Super Target by a man that I didn’t know. He watched me as I loaded my groceries. I quickly loaded my groceries and left. Once I reached the hwy I noticed he was behind me. He followed me to the point where I had no choice to call the cops. He was pulled over and I’m not sure if anything came of it. I experienced only ten minutes of the terror you guys experienced for months! My heart breaks for you because I was terrified! I want thank you for sharing your story because I truly believe it has made me more aware of the people around me. I will keep spreading the word. My heart goes out to you.

    • Lizzie – I am so sorry that happened to you. People should not have their lives intruded on and frightened!

    • Girl abducted from a Target parking lot…Scary!!! You mentioned you were at Target and it reminded me of this….From an episode of “Disappeared” the case of: Kelsey Ann Smith (May 3, 1989 – June 2, 2007) was an Overland Park, Kansas teenager who disappeared on June 2, 2007 and was murdered that evening. The story was featured in the international media, including on America’s Most Wanted, before her body was found near a lake in Missouri on June 6, 2007. Smith was last seen at 7:09 p.m. CST on June 2, 2007 in the parking lot at a Target store at 97th and Quivira, behind the Oak Park Mall in Overland Park, Kansas. Police, other authorities and the national media launched an extensive publicity campaign and search for Smith.

  2. Tina, I like most people have no ” vested” interest in this case, except most of us want to see the truth and justice served for anyone that cares for our fellow human beings. If a proper investigation was done and facts and data confirmed the decision, I would have to send you my sympathy and respect the law. But unless they do an investigation , there is NO discussion! You have presented a very strong case! I know there was a stalker, some people do not think the ast video showed an actual person , BUT how about the other ones? How about Morgan being followed? Why would she lie? Why would anyone be up in the middle of the night saying someone was banging on their window? for attention? From who? Obviously not from law enforcement?

    • And what about when I had a shocking experience with a rock being thrown at my window, and my heart jumped out of my body!!! What about the male that appeared on our front door step at 4:30 am wearing a hoodie – he saw me – I saw him and he took off, alarm went off, Steve could never catch him.

      What about the strange things our next door neighbor saw going on? What about our neighbors dog alerting her at 2:00 am and she looks outside and sees the motion detector light on Morgan’s side of the house is on? I can go on and on, but Morgan wasn’t the only one that heard or saw things, and yes, thanks for reiterating the fact that we have many pictures, videos, footprints, etc. of the stalker – even though the Sheriff’s could never show up in time to catch him…I don’t think any LE could show up in time to catch a stalker – they need a different protocal – new tools to use. Laws & law enforcement protocal need to change to protect the victims. This is not a reactionary crime!

        I can feel your pain in most of your posts, but when you post something like this, it’s just wrong. You and your husband couldn’t catch him and you live there and ran outside constantly. So this is an unfair statement.

        • You are right we didn’t catch him either and we knew nothing about stalkers, we were not professionals, we never took classes, and by the time I finished the book the Detective suggested it only made me see that what they were doing was never going to work so I tried discussing with them how we could all go about working together for a good conclusion, but there minds were made up and they wouldn’t change – that is why it is CRITICAL for local law enforcement agencies (not the victims families because they are not allowed to do most of these things), to adopt the National Effective Stalking Protocol, how to identify what kind of stalker you have, so you know how to deal with this particular type, bring in canine units if you need to, interview the suspect(s) (something the family is not allowed to do), inform the community (for their protection, and also to have more eyes and ears at your disposal), sharing information with other law enforcement agencies in the area, don’t treat stalking as a reactionary crime or it could have deadly results, go stake out and follow the suspect instead of waiting until the suspect leaves and then show up empty handed. This has all been learned and taught by experts not a layman like me – so I just don’t for the life of me know why law enforcement wouldn’t want to do the right thing. Why wouldn’t they want to warn the family, give the family advice, try to save a life?

        • Unfair statement Faye? NOT EVEN. IF your daughter had this happen to her, I’m quite certain you would feel the same way. I think you were completely fair Toni.

        • Unfair Statement? It’s not the parents job to catch him. It IS the sheriff’s office’s job. I believe these parents went above and beyond what most people would have been able to do.

      • Toni, I know I just kind of leapt into the comments here with questions and whatnot without any sort of introduction or commiseration, but I wanted to reiterate what P from PA said above – I have no vested interest in Morgan’s case except I want to see this failure of justice corrected. I have been in a situation or two myself where I was on the wrong end of gross injustice (though not on this level, and I won’t hijack your blog by going into it – it’s not mysterious or interesting at all, at any rate) and it’s left with me a severe case of Wanting to Right the Wrongs.

    • ?, Keenan, Randy, and ?’s dad. Possibly E, ?’s dad, Hannah. Ingram’s you are in my thoughts….some one knows something…that is for sure.

      • & the biggest problem of all would be that these neighbors likely knowingly failed to deter the individual(s) who in all honesty thought it was funny to mess with the hippie-chick down the street- at the beginning… eventually, it really went too far & these people need to come clean about their involvement & tell LE what they know…

  4. You asked “what if it were your daughter…” I can tell you that when I read about Morgan’s love for life, her creativity, her loving friends, I think of my daughter. And when I do, my heart sinks and my stomach flips, making me feel sick and weak. All that and I’m just hearing your story. My heart truly goes out to you, Toni, and you are doing just what I would do. Never let up. Be Morgan’s advocate when no one else will because that’s what mother’s do. From the moment we know we are pregnant, we are our child’s best advocate!

    • You just described exactly how I feel and I cried and I cried…but that’s good, because I have to be reminded that there are other mothers out there that love their children like I love mine, and I never want them to have to go through what I have been going through.

      When I got home just a little while ago I looked up into the sky, and there were so many stars. Whenever I used to get out of the car at night, and Morgan was with me I used to always say, “Oh look at how many stars are out”, she used to get all engrossed in which stars were which…tonight I just said to myself, “Morgan I think you are really far away, like up in the stars, and I wish you were here, all of a sudden (probably because I bumped it or something), my cell phone made a noise. so I looked at it – it was glowing “voice control”, I had to laugh and think, Morgan’s telling me she’s right here with me now. At least I felt that she was.

      • Bumped your phone or not, I’m 100% sure it’s her…. I get “reminders” through street lights…. EXACTLY when I need them.

  5. From what I’m seeing… and this is simply incomprehensible to anyone with common sense…. How is it possible on Gods Green Earth… to visit the scene of a reported stalker without a k9 50 TIMES… let that sink in… visit the call of a reported stalker WITHOUT A K9 50 times!!!! Lets not even get into the argument of Blood Hounds Vs. Belgian Malinois. Obviously, someone thought there was credibility to send an Officer out 50 times otherwise the caller would be subject to charges themselves…. From what I’m seeing… it is certain someone should be charged here… for impersonating a competent law enfo … oh nevahmind…..

    • Twice they said they “might” bring out a canine and my heart jumped with excitement – but it never happened! I think you’re right that should be part of the protocol in a case like this – they should be REQUIRED to bring out a canine. And if there isn’t enough money in the budget – get it!

      • Why isn’t the Sherriff asked about where the K9’s are???? And if there’s money for a tank… where’s the money for a far cheaper k9??? You know… something you might actually use in a county of 60,000… or is it just that in a County of 60,000 you find Journalist as far up on the stellar scale as you would expect to find competence in law enforcement??? The cycle never ends… it just rides a loop on the Crazy Train with everyone congratulating everyone else for a job well done!

    I can’t even imagine the pain. I applaud you for doing what you are doing, reliving this on a daily basis as you are. I have a daughter a little older than Morgan, and my heart aches for you. I have visited some sites that don’t believe there was a stalker, and I can’t even believe someone could come to that conclusion. She was terrorized! My daughter had a kid in town that was a potential stalker. Luckily she left town and cut ties with this kid before anything could happen…she avoids him at all cost to this day. That was frightening enough for her, and she knew who it was. When people get obsessive you just can’t predict what will happen! I just hope that someday soon there is justice for your beautiful daughter. Love from NY.

  7. Hi Toni, I am curious how you know it was the new neighbor Matt driving up the street? I can not even see the street in the video and definitely not the type of car. I thought I could see head lights but I guess that is actually the suspect, so I can’t see anything from the car at all, how do you know who it was?

    • Sure Jenn, The next camera sees his car turning in his driveway. The outside cameras saw the streets pretty well. The driveway camera was really aimed at the cars

  8. I’m really curious to hear about your theory on these other suspects and the idea that there was a “gang”. Just when you thought it couldn’t get worse … I guess the one positive thing (is there such a thing in a case like this?) is that the more involved, the weaker the bond gets, so hopefully one of them will crack one day and spill info.

  9. Talking about more than one person engaging in this kind of behavior requires a change in vocabulary and analysis. It moves from a typical stalking pathology to the group dynamics of bullying and hierarchy. Scary stuff.

  10. I didn’t realize her pajamas were missing from her room. Perhaps you could describe them here. If they were dumped somewhere, people in the area might have come across them dumped somewhere and not even be aware of it.

  11. You have never mention the wound on her hands before? what did it look like? again i am so sorry for your loss.

    • They are described as abrasions and I have as yet been unable to see photos. Dr Doberson just confirmed that abrasions on the top, bottom and wrist of her hand would be consistent with a struggle. Report says no sign of a struggle. Pictures of her room show signs of a struggle. It just goes on and on. I’ll present both sides of the story just as soon as I can.

    It’s taken awhile, and I may have missed some, but I’m following your story and very much believe what you say. Which is sad because I’d rather it was fiction and your beautiful daughter was still with you here on earth. This entry made me cry because I could “hear” the sadness, frustration, and anger that any parent would feel in your situation. I feel it too, for Morgan as well as you and your family.
    It’s clear from the comments that so many people DO care. You just need someone in power to do the right thing. I’m so sorry you are going through this and I’m sure justice will prevail in time.Please know that white light and strength are coming to you from CA.

  13. I am following this blog and I have just one question… Did you ever think about a “real” gun? I am so not a gun person but I feel your frustration and perhaps I missed it but I don’t remember you mentioning being so tired and frustrated that you went out and bought one. I think I may have had to put aside my anti-gun stance. I know you probably would have never had a clear shot at him but i think you would be personally justified and screw getting in trouble for it but legal or not I think I wouldn’t have cared.

  14. I just watched Dr. Phil and that Girl, Brooke, looked guilty, guilty, guilty!! She showed no remorse what so ever and why was Dr. Phil on her side.

    • Don’t know that he was on her side – he believes the investigation should be opened and his staff took us on the side and told us they believed in us 100% and even signed Morgan’s petition to the Governor so I’m not really sure how I feel about the whole thing

  15. I have been reading your blog for a couple months and each day something else just jumps out at me. She had signs of a struggle on her person at her time of death? How in the (excuse me please) hell did they explain that non sense. I mean if someone kills ones self they usually don’t beat their body up first. They take the pills, or whatever their way out is and it’s over. Have you tried to contact the Justice Department of the Federal government about this Mayberry Police force? I think they need investigated by the Federal government. Something is NOT right, how can this happen in these times?

    • Very good question Megan…all your questions + so many more have been driving us to keep going up the chain of command in Colorado with actual evidence, but to no avail, so we have come to the same conclusion as you just did…this will need to go to the Federal government in order to ever get a real investigation.

      First let me explain one thing to you. I found Morgan that morning and screamed for Steve who came running in, put her on her back on the bed and started CPR, while I called 911. Then the 911 operator told us to get her on a hard surface and continue CPR, so we both grabbed her and put her on the floor. At that time her legs were straightened out because I grabbed her ankles and Steve grabbed her shoulders to swing her gently down to the floor. That is the position the sheriffs, etc. saw her in when they got there. But Steve and I both, individually told the first responders and sheriffs EXACTLY how we first found her, on her right side, on the opposite side of the bed she usually slept on, head on her pillow, eyes wide open and black, knees pulled up towards her chest, both arms bent and her left arm up slightly over her body, both fists clenched and her blanket pulled up to her shoulder…someone took the time to stage her body to look like she died in her sleep. Her hair was a mess, all matted, when it was just washed and styled earlier that afternoon, her jaw was clenched, she had a fat lip and there was blood on her forehead and lips. Her neck looked like she had been strangled.

      Steve & I knew nothing about lividity and had no way of knowing what this all meant…but the first responders and the sheriffs sure did. Detective Glassmire (Morgan’s felony stalking detective – now just so you know he is the new coroner for Garfield County) had death scene experience, but he insisted at that very moment that her death could not have been caused by the stalkers. How convenient – they had not even taken her body away for an autopsy at that time.

      They had to have known that very morning that her body had been moved postmortem by whomever killed her – her lividity indicated that. She could not have died in the position we found her in – and dead bodies DO NOT move on their own. But that is when they needed to cover this up otherwise it would have been a homicide investigation, which they would not allow. We had no idea until years later when we finally were able to see some of the crime scene pictures of her body and then forensic crime scene & forensic medical examiners informed us that it was not possible for her to have died in the position she was found in. It’s pretty sick to think of someone pulling up her blanket right up to her shoulder and “tucking” her in.

      It is so horrible to think that these kind of things can happen these days, but unfortunately I now know they do happen. I have been working with other families around the country that are in similar situations – there is no oversight and if you have this happen in an area that does not have a good or honest law enforcement agency then things like this happen. I really want to see that change – I really want to see oversight, transparency and ethics mandatory. These are not bodies – they are and were humans that have rights. They have families that love them and need to see justice done. Our communities need criminals off the streets so they don’t reoffend – but none of this is possible if homicides are brushed under the rug.

        I just remembered that when I watched Morgan’s story on Crime Watch Daily, you said something about her hands and that you thought that her fingers looked like she was trying to sign her killer’s initials. Do you still believe that?

  16. I watched Dr. Phil today a rerun and you and your husband were on there. I knew nothing of this topic whatsoever and I wasn’t really paying attention walking in and out of the kitchen listening. I stopped dead in my tracks when that girl looked you directly in the eye and said “prove it.” I was chilled to the bone. I have been a victim of molestation, as well as domestic violence I know the hyper vigilance, I have been told by a therapist I have PTSD due to the abuse. The mental was far worse than the physical. I moved four hours away from that person and still lived in constant fear of my door being kicked in. The DA would not go through with charges. Small town politics. I know your disgust in the system. I am so very sorry that you and your family has gone through this and is still going through it. I will never completely heal I live in fear to this day. I have three small dogs to alert me of every sound, I sleep maybe two hours a night and I know I am safe. But yet I still can’t sleep. My thinking and behavior has changed forever. I wanted to also mention to you that in one of your blogs you talked about how safe was Morgan in her car. I had all the lug nuts loosened on my car and at 65 miles an hour on the highway my children and I could have been killed. I was keen enough to notice within a few miles
    Thank God that something was wrong. I could not prove who did it. So heads up for people to check lug nuts. Many prayers and heartfelt condolences I send to you and your family.
